Adjustment of administration fees
As of 1 July 2025, the Netherlands Arbitration Institute (NAI) will change the administration fees for arbitration and binding advice proceedings. The new scale and fee calculator can be found here on the NAI website. The new scale replaces the current rates that have been in effect since 1 February 2022.
The principle that the administration fees are higher if the financial interest of the claim is higher will remain unchanged. The increase is necessary due to inflation, higher operating costs, and international competitiveness. The administration fees for claims with a lower financial interest (up to €750,000) will increase proportionally more than those for claims with a higher financial interest. This is necessary to guarantee the quality of the NAI’s services in these proceedings as well.
The NAI is introducing a substantial reduction in the administration fees for emergency arbitration proceedings. From 1 July 2025, a rate of 50% of the regular administration fees will apply to these cases. This takes into account the limited scope and duration of these proceedings. Until now, the same amount was charged for these proceedings as for proceedings on the merits.
