The quality of any arbitration is determined by those who act as arbitrators

The NAI Arbitrator List

In order to guarantee the quality of arbitration at the NAI as much as possible, the NAI uses the NAI Arbitrator List. The NAI Arbitrator List contains a selection of candidate arbitrators who, based on their expertise and/or experience with arbitration, have been admitted to the NAI Arbitrator List by the NAI Board. Any natural person with legal capacity can be appointed as an arbitrator. A listing on the NAI Arbitrator List is not required for this.

Overview of appointments in NAI cases

Most appointments are made on the recommendation of the parties. Appointments may also be made following a proposal by the NAI (list procedure) or directly by the NAI. The latter occurs mainly in summary proceedings.

In the case of direct appointments by the NAI or appointments via the list procedure, the NAI uses the NAI Arbitrator List. If the necessary expertise cannot be found on the NAI Arbitrator List, the NAI will look for a suitable candidate arbitrator outside the NAI Arbitrator List. The NAI also has a good network for this purpose.

Prior to the appointment of an arbitrator in a specific case, the candidate arbitrator must make a statement confirming his or her independence, impartiality and availability.
