Model binding advice clause
Binding advice under the NAI Binding Advice Rules requires that the parties have agreed on the applicability of the Rules through a binding advice clause. The NAI recommends that the following clause be included in the contract. The parties are, of course, free to choose how they formulate the clause. However, in practice, the NAI’s wording has proven to cause the fewest problems.
‘All uncertainties or disputes that may arise from this agreement or from further agreements that may result from it will be determined or settled by binding arbitration in accordance with the Binding Arbitration Rules of the Netherlands Arbitration Institute.’
