Yesterday’s event, “The Next Generation of Disputes in Arbitration,” organized by the Young NAI Committee (NAI Jong Oranje) and kindly hosted by STAUNCH in honor of the NAI’s 75th anniversary, provided a comprehensive overview of current trends and key issues in arbitration. The event featured valuable insights from experienced speakers on critical topics. Tomas Vaal (Secretary General of the NAI) began with an introduction to the NAI’s history, setting the stage for an exploration of how arbitration has evolved over the decades, including its broadening sectoral involvement and rule adaptations to address modern needs.
Irène Léger from STAUNCH opened discussions on W&I insurance arbitration, a rising field in post-M&A disputes, explaining the process, necessity, and potential issues with parallel arbitration proceedings. Following up, Lennart Baijer of Eversheds delved into corporate arbitration and its intersection with Dutch law, including the roles and limitations of the Enterprise Chamber, particularly in shareholder and joint venture conflicts. Lastly, Johannes Fahner from Lévy Kaufman-Kohler covered third-party funding (TPF) in international arbitration, outlining its growth, potential challenges, and the EU Parliament’s recent regulatory proposals aimed at ensuring transparency and accountability.
