What mediation services does the NAI offer?

The NAI mediation services

The NAI administers commercial disputes under the NAI Mediation Rules (click here to read more about mediation). The NAI will quickly process a mediation request so that a mediator can be appointed and a mediation session can be scheduled at short notice. Mediation is confidential. No information is shared with third parties. The parties can jointly select an independent mediator or ask the NAI to appoint one via the list procedure. Mediation may result in a settlement agreement.

Mediation tailored to sector needs

In addition to standard NAI mediation, there are mediation services for specific sectors and/or areas of focus:

  • The Hague Court of Arbitration for Aviation (Hague CAA) is a specialised international arbitration and mediation institute that focuses entirely on resolving disputes within the aviation sector. It was founded in 2022, partly by the NAI, to meet a niche need for efficient, expert and neutral dispute resolution in this complex and highly regulated industry.   • The Court of Arbitration for Art (CAfA) is a specialised international arbitration and mediation institute based in The Hague. It was co-founded by the NAI to resolve disputes in the art world in an efficient, expert and confidential manner — ranging from disputes over authenticity and ownership to breach of contract in art transactions.   • Disputes in healthcare: Based on the Covenant establishing the Independent Disputes Committee for Dispute Resolution and Settlement in Healthcare Contracting, the NAI offers mediation, binding advice and arbitration services in the healthcare sector. A major advantage of these forms of dispute resolution is that the decision-makers and mediators can come from within the sector itself and therefore have all the necessary knowledge.
  • Arbitration in Curaçao: The NAI also offers a fast and effective NAI arbitration procedure for parties doing business in Curaçao. The NAI Arbitration Rules apply if the place of arbitration is in Curaçao. Parties can choose arbitrators who are experienced in the commercial practices of Curaçao. The proceedings can be conducted in any language, including Papiamento.
