NAI recommend arbitration clause
Arbitration in accordance with the NAI Arbitration Rules requires that the parties have agreed on the applicability of these Rules. The NAI recommends the following arbitration clause to be included in the contract. Of course, the parties may choose to phrase their arbitration clause. However, the wording provided by the NAI has proven in practice to cause the least amount of difficulties.
“All disputes arising in connection with the present agreement, or further agreements resulting therefrom, shall be settled in accordance with the Arbitration Rules of the Netherlands Arbitration Institute.”.
The NAI also recommends including a place of arbitration in the arbitration clause. The ‘place of arbitration’ determines the applicable arbitration law. It is merely a legal concept: the hearings may take place anywhere in the world.
